PRIVACY POLICY

Privacy Policy

A Japanese corporation, DEXTAR, Inc. has established the following Privacy Policy regarding the handling of customer information including personal information about customers with respect to the use of services provided by the Company.

1. Policy on Handling of Personal Information

1. When handling information that can be used to identify individual customers, information relating to identification of Service customers, communication service histories, and other information recorded, generated, or accumulated in relation to customer’s devices on which the Services are used (collectively referred to as Customer Information), the Company complies with obligations set forth in the Act on the Protection of Personal Information of Japan, other applicable laws and regulations, and this Policy.

2. The Company is aware that Personal Information is an important asset of the individual, and all persons engaged in the Company’s business comply with personal information protection management systems relating to the protection of personal information and continuously strive to fulfill the trust of customers, employees, and business partners by handling Personal Information and Customer Information reliably and safely.

2.Collected Customer Information and Methods of Collection

The Company collects Customer Information using the following methods in order to achieve the provision of the Services. The Company does not necessarily collect all of the information indicated below for specific Services.

  1. (1) Information provided by Customers
    When using the Services provided by the Company, Customers may provide the information indicated below by directly entering the information or otherwise offering the information so that the Company can manage the Services properly and provide Customers the appropriate services.
    Name;
    Email address;
    Date of birth;
    Credit card information and the like;
    Photos; and
    Other information entered by the customer on input forms specified by the Company.
  2. (2) Information Provided from Collaborating Services
    In cases where the Services collaborate with services provided by third parties, information that the customer provides to the operators of such Collaborating Services or information collected by such operators may be acquired by the Company from the operators of Collaborating Services.
    IDs used by the customer on Collaborating Services;
    Information regarding which the customer has consented to disclosure to Collaborating Services through the privacy settings of the Collaborating Services.
  3. (3) Information Collected by the Company
    When providing the Services, the Company may collect the following information from the Customer or from devices on which the customer uses the Services.
    Information relating to the customer mobile device;
    Service login or use history or billing history information and so on; and
    Cookies and anonymous IDs.
  4. (4) Other Records
    In addition to the matters set forth in the preceding paragraphs, the Company may record the content
    of inquiries from the Customer in relation to the Services.

3. Purposes of Use

The Company uses provided and collected customer information in order to provide the Services and for the following purposes:

  1. (1) to receive registrations relating to the Services; to identify customers; to calculate use fees, and for other purposes relating to the provision, maintenance, protection, and improvement of the Services;
  2. (2) for provision of the Services (including communications with devices on which customers use the Services);
  3. (3) to provide information relating to the Services and to respond to inquiries and the like;
  4. (4) to respond to violations of the Company’s rules and policies relating to the Services and to provide notice of revisions to Rules etc.;
  5. (5) to prepare marketing materials for the Services and to prepare to statistical data in formats that do not allow for identification of individuals;
  6. (6) to provide advertising and promotional information relating to the Company or the Services to customers;
  7. (7) to combine information in the Company’s possession with information received from Collaborating Services to provide services that match customer preferences.

4. Provision to Third Parties

The Company does not disclose Personal Information and Customer Information to third parties without obtaining the customer’s prior consent except in cases where disclosure is permitted pursuant to the Act on the Protection of Personal Information of Japan or other laws and regulations. However, this shall not apply in the following cases:

  1. (1) where the Company entrusts the handling of Personal Information to a third party in whole or in part to the extent necessary to achieve the objectives of use of the Personal Information;
  2. (2) where Personal Information is provided in conjunction with an assumption of business as a result of merger or otherwise;
  3. (3) where disclosure is necessary to cooperate with a request by a national governmental agency, local governmental body, or other body entrusted with such authority; and
  4. (4) where disclosure is permitted pursuant to the Act on the Protection of Personal Information or other laws and regulations.

5. Supervision of Service Providers

The Company may outsource to third parties the handling of Personal Information and Customer Information entrusted to it to the extent necessary to provide the Services and to achieve safe and reasonable use of the Services. Such third parties are selected after confirming that they have adequate security levels with regard to the handling of Personal Information and Customer Information, and the Company performs necessary and appropriate supervision through the execution of agreements and other means.

6. Disclosure of Personal Information

When requested by a customer to disclose Personal Information pursuant to the Act on the Protection of Personal Information, after confirming that the request is from the customer, the Company shall disclose the information to the customer (if the Company does not possess any relevant Personal Information, notice to that effect shall be provided). However, this shall not apply in cases where the Company is not obligated to disclose the information pursuant to the Act on the Protection of Personal Information or other laws and regulations.

7. Correction and Cessation of Use of Personal Information

1. In cases where (1) the Company is requested by the customer to correct to the content of Personal Information pursuant to the Act on the Protection of Personal Information on the grounds that the Personal Information is incorrect or (2) the Company is requested by the Customer to cease use of Personal Information pursuant to the Act on the Protection of Personal Information on the grounds that said use exceeds the scope of the intended uses disclosed in advance or that the information was collected fraudulently or by improper means, after confirming that the request is from the customer, the Company shall conduct an investigation as necessary and, based on the results of the investigation, shall correct or cease use of the Personal Information and shall provide notice to that effect to the customer.

2. Where the Company is requested by customer to delete Personal Information or where the Company determines that compliance with such request is necessary, after confirming that the request is from the customer, the Company shall delete the Personal Information and provide notice to that effect to the customer.

3. The preceding two paragraphs shall not apply in cases where the Company is not obligated to correct or cease use of Personal Information pursuant to the Act on the Protection of Personal Information or other laws and regulations.

9. Privacy Policy Revision Procedures

The Company shall review the status of operations relating to the handling of Personal Information and Customer Information as appropriate and may revise this Policy as necessary. Where the Company revises this Policy, the revised Policy shall take effect upon the provision of notice to the Customer by uploading the revised Policy to the Company’s service site. However, in the case of revisions that require the customer’s consent pursuant to laws and regulations, the customer’s consent shall be obtained by the method specified by the Company.

10. Exclusions to and Voiding of this Policy

The Company shall establish, manage, and operate Rules etc. relating to the handling of Personal Information and Customer Information in accordance with the laws and regulations of Japan. Where the laws and regulations of a country or territory in which the Services are provided differ from the laws and regulations of Japan, the laws and regulations of the relevant country or territory of use shall take precedence over Rules etc. with regard to Personal Information and Customer Information Relating to the Services.
